Auto-entrepreneur living in France invoicing his one-man Ltd company in UK

Hi Valerie,

This is my first post as a new member and I just want to thank you so much for setting up this forum. It has been so helpful already!

I’m in a similar position to EMaroto (https://www.startbusinessinfrance.com/forum/answers/uk-ltd.-director-working-remotely-from-france-in-my-own-uk-company) but I have a different question to hers on invoicing as both an auto-entrepreneur living in France as well as a director of a UK Ltd company.

I have a UK Ltd company of which I am the only director and only employee (called a “Personal Services Company” by the UK tax authorities). I moved to France in October last year and was advised by a French accountant (before I discovered your wonderful forum) to set up as an auto-entrepreneur and then just invoice the UK company.

Your reply to EMaroto’s question suggests that doing this could lead to the French tax authorities seeing my relationship with the UK company as “a disguised work contract”. Can this be solved by me just invoicing some clients from the French company? If so, is there a percentage of annual revenue that should come from other clients?

If not, do you have any other recommendations for what I should do?

Thanks in advance for your help with this,
Chris
