Are royalties considered as being part of the chiffre d’affaires for an auto-entrepreneur?

My husband will be earning consulting income, which will be under the 32,600 euro limit. But he also receives occasional large lump sum royalty payments from his several patents, currently running at about 50,000 euros per year. Would he still be eligible to register as an AE?
