Am I elegible for RSA / CSS under the Withdrawal Agreement, as a ME who arrived pre-Brexit?

Hi Valerie,

I would like to know whether I am elegible for RSA (Revenu de Solidarité Active) and Complémentaire Santé Solidaire (CSS) as a Micro-Entrepreneur under the Withdrawal Agreement, without threat to my visa renewal.

- I am a UK national, I live in france full tim, and am a tax resident (Micro Entr) in France.

- I moved here in June 2020, before Brexit, and have been living here ever since, so I am covered by the Withdrawal agreement.

- 

My 5 yr carte Sejoure is up for renewal in Sept 2026.

- I have been dealing with two serious chronic illness’ whilst trying to establish my new business. These are recognised in the French system and I have ALD status for them.

- My ME earnings have been very low since registering, and I have mostly been living off savings.

2020 Earnings zero
2023 to end of Q1 2004 - some earnings (I paid 6.6euro tax in the ME returns via URSSAF in this period)
2024 start of Q2 - present, pretty much no earnings


I am not earning at all at the moment, trying to get the new business off the ground but struggling due to the illness.

I am also stuggling to meet the healthcare costs not covered by SS / ALD. 

I am currently in the position of not booking healthcare appointments that I need when they fall outside of ALD, as I simply cant afford to pay the % required outside of the portion covered by state healthcare. 



My savings are running out. If I continue with no income, I will be out of funds completely by September, so I will then need to either go into debt, or go on French income support.

If I understand correctly, I am elegible to apply for RSA in June this year, as it will have been 5 years of living here continuously?



And I would be eligible to apply for CSS now, according to my Doctor (I have ALD but no Mutuel)?



These would obviously be invaluable while Im getting my business established whilst navigating illness, and also help hugely with the stress this situation is causing, which is then making my illness’ worse.



I would like to know: 



1. Is the above correct? That I am elegible to apply for both types of support?

2. Is it possble that will there could be consequences for, or any threat to, my visa renewal in Sept 2026 if I apply for support in this period?

3. Or am still receiving support at the time of re-application?

4. Is there a threat of my Carte Sejoure not being renewed anyway, without receiving state support at all, if I am not earning the ME minimum earnings of approx 26k euro by Sept 2026?

5. If, by the time I have established the new entrprise and have a steady turnover, and have been contributing into the system for a devent period, I apply for nationality, could the fact that I’ve had/ applied for state welfare in the past be held against me or threaten my application?



I am obviously extrememly stressed about the financial situation I face at the moment.

I own a home here, most of my extended family live locally, and I intend to live here permanently. I have a solid business proposition and have invested a lot in all the re-training and set up costs. It has just been much slower than anticipated to get it going due my health situation.

I view RSA and CSS as tempoary emergency measures whilst I get through this period and get the enerprise established and generating income.

Having looked online, and spoken to family/ friends and my Doctor, I undestand that I am elegible for both types of support without any threat to my visa renewal or future nationality application, but I would like to double check with you, as, obviously, the consequences if this is incorrect and it was actually to impact on either or both would be extremely significant.
