Which category when adding an ayant droit to my carte vitale?

I’d like to add an ayant droit to my carte vitale. I’ve downloaded the relevant form S3706 but I’m not sure exactly which category my other half falls into. We live together, but are not married and not PACSd. There are two options, he is either La personne qui vit maritalement avec l’assuré(e) et se trouve à sa charge effective, totale et permanente or La personne qui vit depuis 12 mois consécutifs avec l’assuré(e) et qui se trouve à sa charge effective, totale et permanente.
Am I right in assuming that he would fall under 1, because we are living together as though we were married, rather than 2?
