Late payment penalties and rates?

I understand in France, its a lot more strict and it can be legally enforced so my question is: is there a published rate that you must use or can you use anything you like? On my devis / facture, I’m using the phrase Penalties de retard (taux mensuel): 2% which I borrowed from a suppliers invoice. I would welcome clarification on this.
