CFE exoneration in France for a businss?

My husband has received a demand for 412 euros for the cotisation foncière des entreprises (CFE), which I thought he would be exempt from. I think the reason for this is that he closed an Entreprise Individuelle business in France in January 2009 and then started this auto-entrepreneur Jan 11.

Am I right there has to be three years or more between similar activities?
So to confirm, he does need to pay this CFE, is that correct?
